Drunk Driving - DUI

It’s not always illegal to drink and drive. It illegal to drive under the influence of alcohol or drugs or drive with a blood-alcohol-level of .08% or higher. Field sobriety tests have become an object of pop culture. It’s an article of faith that such tests tell the difference between who is intoxicated and who is not. In truth, such tests can be highly subjective and inaccurate. Even breath tests and blood tests can be unreliable as a true measure of a person’s blood alcohol level when driving.

Assault & Battery

Assault (Penal Code 240) is an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another.

Battery (Penal Code 242) is any willful and unlawful use of force or violence upon the person of another.

When assault or battery is committed against certain persons, such as a police officer, roommate, or husband or wife, the penalty is more severe. (Penal Code 243) Also, assault with a deadly weapon—which can mean anything likely to produce great bodily harm—is a criminal offense that can carry serious consequences. (Penal Code 245)

Bench Warrants

 

A judge issues a bench warrant when a person fails to appear for a scheduled court date. The bench warrant authorizes peace officers to arrest the person on sight. If not taken care of a bench warrant can result in detention, forfeiture of bail, and suspension of your driver’s license. Carjacking

 

Carjacking is the felonious taking of a motor vehicle in the possession of another, from his or her person or immediate presence, or from the person or immediate presence of a passenger of the motor vehicle, against his or her will and with the intent to either permanently or temporarily deprive the person of possession of the motor vehicle, accomplished by means of force or fear. (Penal Code 215) Conviction of carjacking is a felony. A defendant charged with carjacking is often charged with other offenses, depending upon the facts, such as vehicular vandalism, joyriding, kidnapping, and theft.

Conspiracy Charges

 

Conspiracy is an agreement to commit a crime. Conspiracy charges are extremely serious and may result in a person facing the same penalties as for the underlying crime itself, even if the person is not the one who carried out the crime. When two or more people agree to commit a crime and take some additional step or action in furtherance of the conspiracy, this constitutes the crime of conspiracy. You don't have to complete the crime to be found guilty. You don’t even need to know all of the people involved in the conspiracy. All the prosecutor has to show is that you got together with someone else and planned to commit a crime, and that someone took some action in furtherance of the conspiracy. Disorderly Conduct

Disorderly Conduct

Disorderly conduct is any number of things in California, including public intoxication, lewd conduct, assaulting another for the purpose of begging or soliciting alms, disturbing another by loud and unreasonable noise, and even using offensive words.


These criminal charges may sometimes have their place. Too often, however, they are used by police officers simply to crack down on conduct they disfavor, including perfectly lawful conduct like panhandling, peaceful political protests, and picket lines. Part of a criminal defense attorney’s job is to remind those enforce our laws where to draw the line. When a person is arrested for disorderly conduct, it’s often an opportunity to protect our rights against heavy-handed and overzealous policing.


It’s not against the law to be drunk in public. It IS against the law to be so intoxicated or high that you are unable to take care of yourself or interfere with others’ use of the street. If someone else is helping you get home you are not guilty of public intoxication. (You are taking care of your safety and well being.) In addition, the police should try to place you in civil protective custody — the drunk tank — rather than press charges and jail you.
